1. Scope and Provider

(1) These Terms and Conditions ("Terms") apply to all orders placed through and the use of our online store.

(hereinafter referred to as "we", "us", or "Lélio Club").

(3) Any conflicting or deviating terms and conditions of the customer shall not apply unless we expressly agree to their validity in writing.

2. Use of the Store / Contract Language

(1) Our store is operated via the Shopify e-commerce platform. Shopify provides the technical infrastructure but is not a contractual party to purchases made through our store.

(2) The contract language is German. Any translations provided are for convenience only and serve solely to improve understanding.

3. Conclusion of Contract

(1) The presentation of products in our online store does not constitute a legally binding offer but rather a non-binding invitation to place an order.

(2) By clicking the button labeled "Buy Now," "Place Order with Obligation to Pay," or a similar button, you submit a binding offer to conclude a purchase contract for the products contained in your shopping cart.

(3) The contract is concluded when we accept your order by sending an order confirmation via email or by dispatching the goods.

(4) We reserve the right to reject orders for legitimate reasons, particularly in cases of suspected misuse or fraud, incorrect information, or unsuccessful payment processing.

4. Customer Account

(1) You may place orders either as a guest or through a customer account.

(2) If you create a customer account, you are responsible for keeping your login credentials confidential and protecting them from unauthorized access.

(3) You are responsible for all activities conducted through your customer account to the extent that you are responsible for such activities.

5. Print-on-Demand Apparel – Special Conditions

(1) We exclusively sell apparel produced through a print-on-demand ("POD") process. This means products are individually manufactured and printed only after your order has been placed.

(2) Product images are provided for illustrative purposes only. Colors may vary depending on your screen settings and display characteristics.

(3) Due to the nature of print-on-demand production, minor technical deviations may occur, including:

slight shifts in print placement;
minor color variations;
customary size and manufacturing tolerances in textiles.

Such deviations shall not constitute defects provided they are minor and commercially customary.

(4) Please carefully review the size charts provided in our store. Selecting the correct size is your responsibility.

6. Prices, Shipping Costs, and Value Added Tax (VAT)

(1) The prices displayed in the store at the time of the order shall apply.

(2) All prices are final prices and include the applicable Value Added Tax (VAT).

(3) Any additional shipping costs will be displayed separately during checkout unless expressly stated otherwise.

7. Payment

(1) The payment methods displayed in the store are available to you.

(2) Payment is due immediately upon conclusion of the contract unless otherwise agreed.

(3) Payment processing may be handled by external payment service providers. Their respective terms and conditions may also apply.

8. Delivery, Shipping, and Delivery Times (POD)

(1) Delivery times for print-on-demand (POD) products consist of production time plus shipping time. Delivery estimates displayed in the store are non-binding unless expressly stated otherwise.

(2) We are not liable for delays beyond our reasonable control, including delays caused by shipping carriers, force majeure events, strikes, or customs procedures.

(3) For consumers, the risk of accidental loss or accidental deterioration of the goods passes only upon delivery of the goods to the customer.

9. Right of Withdrawal

(1) Consumers generally have a statutory right of withdrawal.

(3) Please note that the right of withdrawal may be excluded in cases permitted by law, particularly for goods manufactured according to customer specifications or clearly tailored to personal needs (e.g., personalized products). Non-personalized print-on-demand apparel generally remains subject to the statutory right of withdrawal.

10. Returns, Exchanges, and Complaints (POD Policy)

(1) Returns under the right of withdrawal are governed by our Withdrawal Policy.

(2) Defective Products / Production Errors / Incorrect Deliveries

If a product arrives damaged, was delivered incorrectly, or contains a printing or manufacturing defect, we will offer either a free replacement or a refund. Please contact us within 14 days of receipt by email at support@lelioclub.com and provide photographs documenting the issue.

(3) Exchanges (e.g., Size Changes)

Direct exchanges are not always possible within the print-on-demand production process. In such cases, customers may return the item in accordance with their withdrawal rights and place a new order for the desired size.

11. Retention of Title

The goods shall remain our property until full payment has been received.

12. Intellectual Property

All content and designs displayed in this store are protected by copyright and other intellectual property laws. Any use, reproduction, distribution, or exploitation without our prior written consent is prohibited.

13. Reviews and Feedback

(1) Reviews and feedback must not infringe the rights of third parties or contain unlawful content.

(2) You grant us the right to use feedback (including reviews) for display within the store and for marketing purposes (including on our website and social media channels), to the extent permitted by law.

14. Prohibited Use

Misuse of the website or Services, automated attacks, unauthorized data collection, or attempts to circumvent security features are prohibited. In the event of violations, we reserve the right to restrict access, suspend accounts, and pursue legal action.

15. Statutory Warranty Rights

The statutory warranty rights provided under applicable law shall apply.

16. Liability

(1) We shall be liable without limitation:

in cases of intent and gross negligence;
for injury to life, body, or health;
under applicable product liability laws;
in cases of fraudulent concealment of a defect.

(2) In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), our liability shall be limited to the foreseeable damage typical for the contract.

(3) Any further liability is excluded to the extent permitted by applicable law.

18. Relationship with Shopify

(1) Our online store is operated through Shopify. Shopify provides the technical infrastructure and e-commerce platform for our store.

(2) All purchases are concluded exclusively between you and Oleg Bachowka, trading as Lélio Club. Shopify is not the seller and is not a contractual party to any orders placed through our store.

(3) Shopify assumes no responsibility for purchases, orders, returns, refunds, or any other disputes between you and us.

19. Final Provisions

(1) These Terms and Conditions shall be governed by the laws of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

(2) If you are a consumer and have your habitual residence in another EU member state, the mandatory consumer protection provisions of that country shall remain unaffected.

(3) Jurisdiction

For consumers, the statutory place of jurisdiction shall apply.
For business customers and merchants, the place of jurisdiction shall be Munich, Germany, to the extent permitted by law.

(4) Should any provision of these Terms and Conditions be or become invalid, unenforceable, or void, the validity of the remaining provisions shall remain unaffected.
